16. Criminal convictions

16.1       At commencement of your employment with the Company you will be required to participate in an enhanced DBS (Disclosure and Barring Service) Status Check to ensure that you do not have any undisclosed convictions.

16.2       If you have an existing DBS Certificate and are on the Update Service when you commence employment with the Company, we will search online to see whether there has been any new information since its issue.

16.3       For existing employees, as your current DBS certificate comes up for renewal, you will be sent the information to enrol on the Update Service. You will be required to send the details of your certificate number, the issue date and your unique ID number to the BCC administrator. Under your contract, or contract addendum, you agree to pay the annual renewal fee and to allow us ongoing access to your information. We will check on the Update Service every six months.

16.4       During this process there will also be a search on the Protection of Children Act List (POCA), the list held under Section 142 of the Education Act 2002 (previously referred to as List 99) and the Protection of Vulnerable Adults list (POVA). Inclusion on any of these lists, or failure to disclose any criminal convictions, may result in an offer of employment being withdrawn or disciplinary action resulting in dismissal.

16.5       During your employment you are required to inform the Managing Director of any convictions, court orders, reprimands and warnings, including road traffic offences, that may affect your suitability to work with children. Failure to disclose any convictions may lead to disciplinary action resulting in dismissal.
